Goods, moved the Court for a Writ of Fieri Facias against the defendants lands; the main argument was as to the effect of the Imperial Act of 1732; the Court divided in opinion, Allcock, , considering that the land was not exigible at all, while Elmsley, and Powell, , thought the Statute applied; but did not agree as to the form of the Writ accordingly, the plaintiff "took nothing by his motion.
