It may be said that while this doc- trine has been uniformly followed in the courts it was strongly disputed by lawyers of high standing in England and Canada.

The matter being referred by the Privy Council to this Stand- ing Committee, it was considered advisable to take the opinion of the Law Officers of the Crown on the legal question involved.
